Eligibility and Application Process
The new system is designed to allow lawyers and individuals with ongoing cases to participate in their court hearings remotely from their homes or other locations. This is particularly beneficial for those who find it difficult to appear in person due to various challenges.
Eligibility for the video link service is extended to individuals who are unable to attend court due to illness, disability, long distances, travel restrictions, or security concerns. However, it is explicitly stated that proclaimed offenders are not permitted to use this facility.
Interested parties can apply for a remote hearing through a dedicated form available on the official website of the Punjab district judiciary. Applications must be submitted within a seven-day window, excluding Fridays and Saturdays. Once an application is approved, the court will schedule a suitable date and time, and the case list will clearly display a "Video Link" tag for identification.
Security Measures and Overseas Participation
To maintain the integrity of the judicial process, robust security protocols are in place. Before a hearing begins, plaintiffs or witnesses must be present at the designated location with their original CNIC or passport for biometric verification. Court staff will assist disabled individuals with this verification process. It is important to note that any travel expenses incurred remain the responsibility of the applicant.
The facility also accommodates witnesses located abroad. They can join the court proceedings through Pakistan's embassies, high commissions, or consulates. A designated officer will supervise their testimony, and no electronic devices or third parties are allowed during the recording. The statements of overseas participants will be taken according to Pakistani judicial timings under the provisions of the Oath Act 1873.
Recording and Data Preservation
All proceedings conducted via video link will be officially recorded by the court. To prevent unauthorized recording, the use of personal devices like mobile phones is strictly prohibited on court premises.
Applicants are required to provide a USB drive or an external hard drive with a storage capacity between 125 and 500 GB to store the recordings of their hearing. These recordings, secured with judicial seals and passwords, will become a formal part of the official case file and will be preserved securely as part of the legal record.
