Timothy Busfield is seeking to have the grand jury indictment against him thrown out as he continues to fight child sex abuse charges in New Mexico. According to court documents obtained by Entertainment Weekly, the 69-year-old actor has filed a motion to quash the indictment, arguing that prosecutors engaged in misconduct during the grand jury proceedings and prevented jurors from hearing evidence that could have supported his defence.

Attorney Maintains Innocence

Busfield's attorney, Stanton “Larry” Stein, maintained his client's innocence in a statement shared with the outlet. “Timothy Busfield is innocent,” Stein said, alleging that prosecutors suppressed exculpatory evidence, misstated the law and denied the actor basic due process protections. He claimed the grand jury repeatedly requested additional testimony, witnesses and evidence, but those requests were not fulfilled.

Details of the Indictment

The West Wing star was indicted in February 2026 on four counts of criminal sexual contact involving a child under the age of 13. Two of the alleged incidents are said to have occurred on October 19, 2022, while the remaining two allegedly took place on September 11, 2023. Busfield has pleaded not guilty to all charges and has consistently denied the allegations.

Background of the Case

The case stems from accusations involving twin boys connected to the Fox drama The Cleaning Lady, where Busfield worked as an executive producer and director. An investigation reportedly began after concerns were raised by a doctor at the University of New Mexico Hospital in November 2024. Busfield surrendered to authorities on January 13, 2026, after an arrest warrant was issued and was later released pending trial.

Previous Criticism and Independent Investigation

At the time of the indictment, Stein criticised the prosecution, arguing that the case could not be proven at trial and claiming there were significant weaknesses in the state's evidence. He has also previously said an independent investigation conducted by Warner Bros. found no evidence supporting the allegations.

Upcoming Court Dates

A status hearing in the case is scheduled for June 30, 2026, with Busfield's trial currently expected to begin in May 2027. If convicted, he could face a minimum prison sentence under New Mexico law. Busfield's motion does not affect the charges themselves, and prosecutors have not publicly responded to the latest allegations of misconduct. The case remains ongoing.
