IHC Seeks AGP Help on Ombudsperson Powers Delegation

The Islamabad High Court (IHC) has issued a notice to the Attorney General for Pakistan, seeking assistance on a key legal question concerning the delegation of statutory powers by the Federal Ombudsperson for Protection Against Harassment. Chief Justice Sardar Muhammad Sarfraz Dogar passed the written order while hearing a petition filed by Dr Rizwan Taj, who has challenged an order issued by the harassment ombudsperson on October 10. The court also suspended the impugned order pending further proceedings.

Legal Question on Delegation of Powers

The court has raised the question whether the Federal Ombudsperson can delegate statutory powers to another officer. The assistance of the Attorney General has been sought to clarify this legal point. The case will be heard again on a date to be fixed later.
