Mardan AC Orders Removal of Encroachments from Bazaars

Assistant Commissioner (AC) Mardan Dr. Ahmad Dogar has issued a notice directing all market unions, shopkeepers, traders, and businessmen to immediately remove all types of encroachments from bazaars and public roads. According to the notice, all forms of encroachment on roads, footpaths, streets, government land, drains, and other public places are illegal and punishable under the law.

Details of the Notice

Shopkeepers have been directed to immediately remove goods displayed in front of their shops, as well as stalls, sheds, cabins, kiosks, carts, handcarts, and other unauthorized structures. The notice states that under Section 66 of the Khyber Pakhtunkhwa Local Government Act, 2013, individuals found guilty of encroachment may face imprisonment for up to three years, a fine of up to Rs50,000, or both. In cases where the violation continues, an additional daily fine may also be imposed.

Legal Authority and Enforcement

The notice further states that under the Khyber Pakhtunkhwa Public Property Removal of Encroachments Act, 1977, the administration has the authority to immediately remove encroachments, evict illegal occupants, and demolish unauthorized structures. All expenses incurred during such operations will be recovered from the occupants concerned. According to the notice, those found illegally occupying government or public property may also face fines, imprisonment, recovery of damages, and financial penalties of up to Rs2 million.

Equipment and materials used in encroachments, including kiosks, carts, sheds, construction materials, and other items, may be confiscated and taken into government custody. The AC has directed all shopkeepers to remove their encroachments voluntarily; otherwise, the district administration will launch indiscriminate enforcement operations and take legal action.

Compliance and Responsibility

The notice states that full responsibility for any consequences will rest with the concerned shopkeeper or occupier. Presidents of all market unions have also been directed to prominently display the notice in their respective markets and ensure its implementation. However, the notice does not specify a deadline for compliance.
