The Federal Constitutional Court of Pakistan on Thursday dismissed a petition filed by Saima Shehzadi, who alleged she had been subjected to rape. A three-member bench, led by Justice Hasan Azhar Rizvi, heard the case, during which counsels for both parties presented their arguments.
Court Questions Marriage After Alleged Rape
During the proceedings, Justice Rizvi questioned why the woman married the same person if she had been raped. The defense counsel responded that the accused allegedly married the woman to conceal the incident. The court was informed that the alleged offense occurred on June 17, 2025, and the parties were married on June 26, 2025. The petitioner's counsel further stated that the accused divorced Saima Shehzadi on August 6, 2025.
Justice Rozi Khan's Observations
Justice Rozi Khan observed that it was unusual for a marriage to end in divorce under such circumstances, remarking that such stories were extraordinary and more commonly seen in films. After hearing arguments from both sides, the Federal Constitutional Court dismissed the petition.
The court also emphasized that the autonomy of high courts must be respected, a principle reaffirmed by the Federal Constitutional Court in its ruling.
