The Federal Ombudsman for Protection Against Harassment (FOSPAH) has imposed a combined fine of Rs2.7 million on five officials of a private company after finding them guilty of sexually harassing a female employee and retaliating against her for reporting the misconduct.
Complaint Details
According to the complainant, she faced inappropriate behavior including unwanted meeting invitations outside the office, unwelcome physical contact, and derogatory remarks. She also alleged that the company’s internal complaint process failed, with key CCTV evidence not being secured. Retaliatory actions forced her resignation while her dues were withheld.
Ombudsman’s Ruling
During proceedings, the accused attempted to shift blame by questioning the complainant’s personality and attire. Rejecting these arguments, the Ombudsman ruled that a woman’s personality or social behavior cannot justify harassment, emphasizing that politeness does not constitute consent and employers are responsible for ensuring a safe workplace.
Evidence and Penalty
Based on witness testimonies and forensic evidence, FOSPAH upheld the harassment and retaliation charges. The total fine of Rs2.7 million was imposed on the five officials. Additionally, the company has been directed to reconstitute its anti-harassment committee within 30 days to comply with legal requirements.
